About these terms

These terms apply to pulseflowautomations.com and to the services PulseFlow Automations ("PulseFlow," "we," "us") provides. By using the site or signing up for a plan, you agree to them.

Our services

We offer three plans:

• Website: a redesigned website, hosting, and maintenance and fixes. $499 one-time setup, then $149 per month.
• Lead Response: form text-back, missed-call text-back and follow-up sequences. $199 one-time setup, then $99 per month.
• Website + Lead Response: everything in both plans. $499 one-time setup, then $199 per month.

Plans with Lead Response include up to 1,000 text messages per month. A text is up to 160 characters. Extra texts are 3 cents each, added to your next bill.

Maintenance and fixes means keeping your site online, secure, and working, and repairing anything that breaks. Simple content swaps, such as updating your hours, phone number, or a photo, are included. New pages, redesigns, and new features are quoted separately.

Free homepage preview

The free preview is a design sample with no obligation to buy. We keep ownership of preview designs unless you sign up for a plan.

Payment

Payments are processed by Square. The setup fee is paid when you sign up, and the monthly fee is billed through Square after signup. We never collect card details on our website.

• Setup fee refunds: the setup fee is non-refundable once work has started.
• Cancellation: plans are month to month. Cancel any time with 30 days' written notice. Monthly fees are not refunded for partial months.
• Late payments: invoices are due upon receipt. If a monthly invoice is unpaid for more than 7 days past its due date, we may pause your services until the balance is paid.

Founding-client offer

For our first five clients, we waive the setup fee in exchange for a written testimonial we may publish, and a commitment to at least three months of the monthly plan. If a founding client cancels before completing three months, the waived setup fee becomes due.

Your responsibilities as a client

• You confirm you have the right to contact the people our automations text and email on your behalf, and that your forms collect any consent required by law (such as the TCPA) and by phone carriers.
• You approve the wording of the messages we send for your business.
• You give us accurate information and the access we need (for example, to your domain or phone settings) to set up and maintain the service.
• You won't use our services to send spam or anything unlawful.

Text message terms

PulseFlow Automations text messages. If you opt in on our website, you'll receive texts from PulseFlow Automations about your request, including follow-ups. Message frequency varies. Message and data rates may apply. Reply STOP to cancel at any time; you'll get one final message confirming you've been unsubscribed. Reply HELP for help, or contact us at hello@pulseflowautomation.com or (831) 884-6152. Carriers are not liable for delayed or undelivered messages. Consent to receive texts is not a condition of purchase. See our Privacy Policy.

Ownership

You own your domain name, text, photos and logo. We own the website design and code while we host your site. If you cancel, the website is taken offline, and you may purchase a copy of the website files for a one-time fee of $499. The automation workflows we build and run remain ours.

Service availability

We rely on third-party providers such as Make.com, Twilio, SendGrid, Square and Netlify. We work to keep everything running, but we can't guarantee the service will be uninterrupted, or that every message will be delivered.

Limitation of liability

To the extent allowed by law, PulseFlow is not liable for lost profits, lost business or indirect damages, and our total liability is limited to the amount you paid us in the three months before the claim.

Governing law

These terms are governed by the laws of the Commonwealth of Virginia.

Changes

We may update these terms. If we do, we'll change the effective date above and let current clients know about significant changes.
